I. Information on the protection of personal data

Who is the administrator of your personal data?

The administrator of your personal data is Marc Kolor sp. z o.o. with its registered office in Gdynia, 14c Opata Hackiego Street (hereinafter referred to as PDC). Subjects using the PDC website are hereinafter referred to as Users.

How do we collect personal data?

We collect personal data during:
1. using the website;
2. using the contact channels provided by us.
We collect personal data of both natural persons and representatives of legal persons or other organizational units. In the latter case, we formally receive information about the representative from the organization you represent. The categories of data we process are indicated below.

Use of the website

The website uses cookies, so each time you access the site, we will collect data including your unique identifier. Until you use any form on the website, however, we will not be able to determine your identity.

a. perform analysis related to User traffic on the website;
b. to maintain your session after logging in, so that you do not have to re-enter your login information after navigating to particular sub-pages;

For the purpose of performing analyses related to User traffic, we use the Google Analytics tool provided by one of Our trusted partners, i.e. Google Ilc. based in the USA (hereinafter: “Google”). Google will not access any other data about You that would allow it to determine Your identity.

Blocking cookies may result in some features of the Site not working properly. We may also collect navigational data about you, i.e. information about the links and references you have chosen to click on or other actions you take on the Website (we will refer to this data as: “Navigational Data”). Navigation Data will be collected to analyze your activity, your preferences, as well as to create your profile, which will allow us to optimally personalize the content presented on the website. This profile will also include data you provide to us when registering or in the course of using the functionality of your account.

Use of the contact channels provided by us, i.e. email and contact form

For your convenience, we have created the following channels for you to contact us:
a. contact form on the website;
b. e-mail;
c. telephone contact.

In order to use the form available on the website, you will be required/us to provide an e-mail address. We may also process other data that you provide to us in connection with your request.

If you contact us by e-mail, we will process your e-mail address, the identification data assigned to your e-mail account, as well as possibly other data you provide in the content of your correspondence in connection with the request. If you contact us by telephone, we will process your telephone number, as well as possibly other data provided by you in the content of correspondence in connection with your application.

The provision of data is voluntary, but in the case to the extent that it includes an e-mail address or telephone number (depending on the contact channel), it is necessary in order to get in touch with us and to send a response back.

What regulations govern the processing of personal data?
The issue of personal data protection as of May 25, 2018 is governed by the provisions of the so-called RODO, i.e. Regulation (EU) 2016/679 of the European Parliament and of the Council of 27.04.2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (General Data Protection Regulation).

For what purpose and on what basis do we process data?
We will process personal data for the purposes and on the basis of the following grounds:

b. maintaining your session after logging in, so that you do not have to re-enter your login credentials after navigating to particular sub-pages;
c. personalizing the content presented on the website.

Navigation data will be processed to analyze your activity, your preferences, as well as to create your profile, which will allow us to personalize the content presented on the website. For the purpose of creating a profile, your data provided during account registration will also be processed.

Data collected when you use the contact channels provided by us

Your data will be processed by Us for the purpose of processing your request. The basis of the processing is Our legitimate interest, which consists in ensuring the highest standards of service for customers and potential customers, including enabling the designated persons to obtain information on our offer and the principles of our business.

Who do we share your data with?

Recipients of your personal data:
a. collected during your use of the website are: the entity that provides us with tools to analyze user activity;
b. given in connection with the use of the contact channels provided are: information system providers, e-mail provider.

Data may also be transferred to public authorities, provided they are authorized to do so by applicable regulations and submit an appropriate request, but never otherwise. Any transfer/sharing of data will take place in accordance with the RODO.

How long will we keep your data?

We will store your data:
a. data collected when using the website – for the period indicated in detail in the Cookie Policy;
b. data provided in connection with the use of contact channels provided by us – for a period of 3 months.

Data will be stored by Google Analytics for a period of 14 months or for the period necessary to provide services to you. PDC does not store any personal data unless you have had active communication with us.

What rights do you have?

You have the right to access, rectify and delete your personal data, and moreover to request restriction of processing and data portability.

If we process your data on the basis of your consent, you can withdraw this consent at any time. However, this will not affect the lawfulness of the processing we performed on the basis of your consent prior to its withdrawal. You can revoke your consent at any time from within your account or by contacting us at naruszenia.rodo@marckolor.pl

If the processing is carried out on the basis of Our legitimate interest, you may also object to the processing (including profiling) on grounds related to your particular situation. You may also object at any time to the processing of personal data for direct marketing purposes (including profiling), to the extent that the processing is related to such direct marketing.

If you consider that the processing of your personal data is not in compliance with the regulations, you can file a complaint with the President of the Office for Personal Data Protection.

Will we transfer your data outside the EEA?

The implemented Google Analytics plug-ins and the use of other third-party services result in the transfer of data on the use of our website to the parent company of the service provider, i.e. Google LLC, and therefore outside the European Economic Area. The transfer of data occurs to the United States, where, under certain national security programs, U.S. public authorities may access your data. We do not plan to transfer personal data to third countries or international organizations (i.e. outside the European Economic Area) for the rest. However, should something change in this regard, we will ensure that such entities provide a guarantee of a high level of personal data protection in accordance with the RODO.

Will there be automated decision-making in the course of processing?

Your personal data will not be processed by automated means (including profiling).

II. Cookie policy

I. General information
1. Polit The Cookie Policy applies to the use of cookies as part of the use of the website (hereinafter: the Site) operated by Marc Kolor Sp. z o.o. with its registered office in Gdynia, 14c Opata Hackiego Street (hereinafter: the Owner). Entities using the Site are hereinafter referred to as Users.
2. The Owner performs the functions of obtaining information about Users and their behavior as follows:
a. by voluntarily entering information in the forms;
b. by storing cookies on terminal equipment;
c. through the collection of web server logs by the hosting provider.
II. Information in the forms
The Owner collects information about Users in a manner consistent with the provisions of applicable law, in particular the Regulation of the European Parliament and of the Council on the protection of individuals with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (RODO).
III. Information about cookies
1. Cookies are computer data, in particular text files, which are stored on the User’s terminal device and are intended for use on the Website. Cookies usually contain the name of the website from which they come, the time they are stored on the end device and a unique number.
2. The entity placing cookies on the User’s final device and accessing them is the Owner.
3. Cookies are used for the following purposes:
a. creation of statistics that help to understand how Users use the websites, which allows to improve their structure and content;
b. maintaining the User’s session (after logging in), thanks to which the User does not have to re-enter his/her login and password on each sub-page;
c. customization of the content presented on the Site to the User’s preferences.
By agreeing to the use of cookies for analytical purposes, you must be aware that information about your browsing sessions (e.g. time spent on visited subpages) and Google Analytics service identifiers will be transferred to Google servers located in the USA. Due to Google’s failure to apply appropriate safeguards, the aforementioned data may be made available to US services at their request.

IV. Server logs
1. Information about certain behavior of Users is subject to logging in the server layer. This data is used exclusively for the administration of the Site and to ensure the most efficient operation of the hosting services provided.
2. The record may be subject to:
a. the time of arrival of the order or inquiry;
b. the time of sending the response;
c. the name of the User’s station – identification implemented by the http protocol;
d. information about errors that occurred during the execution of the http transaction;
e. URL address of the page previously visited by the User (referer link) – in case; when the passage occurred through a link;
f. information about the User’s browser;
g. information about the IP address.
3. The above data are not associated with specific persons browsing the pages.

V. Cookie management
1. The User shall be informed of the use of the above forms of data collection when entering the Site for the first time. The User should read this information and accept it or change their browser settings.
2. If the User does not want to use cookies, he/she can change his/her browser settings. We stipulate that disabling cookies necessary for authentication processes, security, maintenance of User’s preferences may make it difficult, and in extreme cases impossible, to use the Site.
